1. Acceptance of Terms

By accessing or using GutterApp™, you agree to be bound by this End User License Agreement (“Agreement”). If you do not agree to these terms, you may not use the application.

2. Use of the Application

GutterApp™ grants you a non-exclusive, non-transferable license to use the application for its intended purposes. Any unauthorized use of the application is strictly prohibited.

3. Disclaimer of Liability

GutterApp™ is provided on an “as is” and “as available” basis, and we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. You acknowledge and agree to the following:

• SMS Leads and Generated Leads: GutterApp™ is not liable for the quality, accuracy, or outcomes of SMS leads or any leads generated through the application. You assume full responsibility for the use of such leads.

• Merchant Fees and Credit Card Processing: GutterApp™ is not liable for any issues, disputes, or losses related to zero merchant fees or credit card processing services.

• Business Interruptions: GutterApp™ is not responsible for any business losses, including but not limited to lost customers, revenue, or opportunities, arising from application downtime, maintenance, or any other technical issues.

4. Limitation of Liability

To the maximum extent permitted by applicable law, GutterApp™ and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the application.

• Any unauthorized access to or use of our servers.

• Any interruption or cessation of transmission to or from the application.

5. User Responsibility

You are solely responsible for your use of GutterApp™, including ensuring compliance with all applicable laws and regulations. You agree to indemnify and hold harmless GutterApp™ from any claims, damages, or liabilities arising out of your use of the application.

6. Termination

GutterApp™ reserves the right to terminate or suspend your access to the application at any time, with or without cause, and without prior notice.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which GutterApp™ operates. Any disputes arising under or in connection with this Agreement shall be resolved exclusively in the courts of that jurisdiction.

8. Modifications to the Agreement

GutterApp™ reserves the right to update or modify this Agreement at any time. Continued use of the application after such changes constitutes acceptance of the revised terms.

By using GutterApp™, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
